			<content:encoded><![CDATA[<p>Mike owns an automotive repair business.  He is a one man operation and has one assistant.  He sees 5 to 20 customers a day and completes about 6 repairs a day.  He is open 5 days a week. Closed on Saturday but spends most of his day inside his garage trying to catch up.  He does great work and has more divulge business than he can handle.  He does not want to expand.  He has 5 cars in his repair bay at any one time and carries insurance in case of shatter ins and vandalism.  It has happened and has cost him dearly in the past.
</p>
<p>But unlike large repair facilities he doesn&#8217;t have a staff to handle the more mundane tasks of running a garage.  So many times a car is dropped off, an estimate is given, a deposit is tranquil for parts and the car is repaired.  But the owner does not advance back in a timely manner to pick it up.  Usually this has something to do with finances and paying for the repairs.  Mike spends his time trying to call and obtain but the car just sits in his repair bay taking up valuable space and becoming a liability.
</p>
<p>Recently Mike took a vacation.  Not from work but from accepting new work.  He spent two weeks doing nothing but cleaning his property of vehicles.  He finished all the repairs that had been put on hold, he took in no original business and spent time collecting for old business.  When he was finished there were 5 cars left on the property.  These cars had all been there more than 60 days and one almost a year.  They were repaired and ready to be picked up.  His investment in labor and parts was over $5000.  A significant sum of money to a small one man operation.
</p>
<p>While visiting Mike one day we talked about these cars and what should be done.  So a little bit of research told us that these cars could be declared abandoned and he could take title and sell them at a public sale to recover his costs.  Seemed like a lot of work, cost and proper minefields to get through but it was a task he was distinct to enact.  While most states have abandoned vehicle laws and procedures for disposing of them each state is different and what Mike was able to do only applies to Alabama abandoned vehicles.
</p>
<p>The AL statute that applies to abandoned motor vehicles is <strong>The Abandoned Motor Vehicle Act, Code of Alabama 1975, Title 32, Chapter 13.</strong>  The act is designed to protect both current owners of vehicles and also those to who vehicles are entrusted.  There are a number of steps involved in getting title to an abandoned vehicle and those steps must be followed in order to complete the transaction and ensure a clean title for the eventual owner of an abandoned vehicle.
</p>
<p>The first step has to do with determining whether a car can be declared as abandoned.  For a repair facility this means either 60 days after it is left for repair when no time is agreed upon or 60 days after repairs are complete.  These days are significant and must be noted by the garage in order to make sure that the vehicle will be declared abandoned by the Department of Motor Vehicles.
</p>
<p>The second step is obtain a vehicle represent from the state that shows the current owner and their address along with any lien holders on the title.  Again very important to make sure that this report is obtained from the state and is accurate.  Once this information is obtained the owner must be notified or attempts must be made to roar the owner and the lien holders of the vehicle&#8217;s location and the costs to recover the vehicle.  You must also tell them that it will be for public sale and what date that sale will take place.
</p>
<p>The garage owner must also place an announcement in the local paper or in the courthouse that gives notice of this sale.  The notice must be posted twice at least 7 days apart and 30 days prior to the sale.  Again the time and dates are very specific and must be followed to ensure a proper transference of title to any unusual owner.  One the sale is complete there are several other state forms that must be completed prior to transferring title.  These forms are not difficult but do require some time to effect sure that they are done right.
</p>
<p>So far Mike has gotten $3600 for his troubles and he still has 3 cars to go.  He will recover his expenses and actually not get burned when all is said and done.  However, this lesson has taught him one of the great lessons of any business.  Keep good records, make good decisions and follow up on all your current business.</p>

			<content:encoded><![CDATA[<p>There are many options in today&#39;s market for midsize crossover SUVs. In this article we will be talking about the offerings from Japanese carmakers Toyota and Honda. With this year&#39;s CR-V priced at $21,695 and the RAV4 just $205 more, this crossover battle is sure to be fierce.
</p>
<p>This year&#39;s RAV4 includes the basic 2.5L inline four engine that is able to compose 179hp. That competes with the CR-V&#39;s 2.4L four-cylinder that provides a strikingly similar 180hp. Honda offers no factory engine upgrades, but Toyota gives you the option to upgrade to a 3.5L V6. The V6 is quicker and only a bit less efficient. Toyota also gives you the choice to opt for a manual transmission- something that Honda lacks. This flexibility of options provided by Toyota gives them an advantage.
</p>
<p>Gas mileage is a specification heavily scrutinized in the purchase of most cars. Luckily for you (and your wallet), both SUVs feature impressive ratings. The Honda averages 21mpg city and 28mpg highway, while the Toyota achieves an estimated 22mpg city and 28mpg highway. With the V6 upgrade there is only a petite dip in efficiency as the ratings drop to 19mpg city and 27mpg. All numbers are EPA estimated. Toyota&#39;s V6 provides almost 100 more horsepower than the Honda, and the mileage statistics are almost identical, which is another advantage for Toyota.
</p>
<p>As you would inquire of in a SUV designed for families, crash test ratings are excellent for both cars. The National Highway Traffic Safety administration awards both cars five star (perfect) ratings for front impacts. The CR-V receives another perfect rating for side impacts, but the Toyota only earns a four. The Insurance Institute for Highway safety awarded the RAV4 a &#8220;good&#8221; rating for roof strength to the CR-V&#39;s &#8220;marginal&#8221;. Neither car has an advantage here.
</p>
<p>While both cars are practical, the CR-V does it with more style than the rival RAV4. Edmunds.com calls the CR-V&#39;s cabin &#8220;functional and attractive&#8221;. Honda offers five levels of trim which vary from basic to leather seats and a satnav. Toyota&#39;s highest package is the Limited Premium which features leather seats, touchscreen satnav, and satellite radio.
</p>
<p>The Honda CR-V and the Toyota RAV4 are both very noble options when considering a crossover SUV. However, while Toyota offers options such as a V6 engine and a manual transmission, Honda does not. This theme of customization is evident in the interior packages as well- Honda&#39;s only optional feature is a satnav, while Toyota has options regarding headlights, lumbar support, and more. The V6 RAV4&#39;s efficiency, power, practicality and personalization qualities acquire it the superior choice in the crossover SUV market.

			<content:encoded><![CDATA[<p>Growing up in Michigan, it had always been my intention to avoid the automotive industry and its volatile nature, but as many people find, especially those in the Flint and Detroit area, it is very difficult. Ten years ago, when I graduated from U of M, I started pursuing a job as a technical writer and quickly learned that Michigan&#8217;s economy was already suffering. It took over a year before I landed a job with EDS, a contract company to General Motors OnStar where I activated the vehicles phone systems. The job was an hour commute as I lived in Flint and found myself driving to Troy.
</p>
<p>I spent two years watching EDS flounder and searching for a technical writing position and when the company finally lost their account with GM I took a position as an Asset Manager encourage in Flint. The position was with another contract company called ICR and I was to manage the inventory of repair parts at GM Flint Metal Center. This work lasted another four years until they too lost their sage with GM. It was at this time that I moved to my current employer, Lincoln and began my MFA program with the hopes of finally getting out of the automotive worlds customary cycle, now you&#8217;re here now you&#8217;re not.
</p>
<p>Over the years I saw a lot of people lose their jobs to outsourcing, India, Canada, Mexico etc. It was while working with Lincoln that I experienced the worst of the attrition that happened at the big three automakers though. I watched thousands upon thousands of people get forced into early retirements or simply lose their jobs. It was dumbfounding to hear then that President Obama was touting gains in automotive jobs since June. When I think of a gain I think of surpassing a previous milestone.
</p>
<p>In my opinion, Michigan has yet to gain any jobs in the automotive industry.  These are jobs that already existed and have now been re-filled, but here in lies the real problem. What Obama fails to mention is that the workers being brought serve are either temporary or are workers who have been brought back at half the pay that those jobs use to make. What is certain though is that the big three venerable the economic downturn to their advantage by breaking the unions, cutting salaries, hourly wages and benefits while increasing profitability, none of which has been passed on in the form of cheaper vehicles for the public.
</p>
<p>Three days ago I was speaking with a supervisor at GM&#8217;s Buick Plant 81 and he was ranting about how the company had re-hired several retired employees. I told him that was great, but then he said it wasn&#8217;t because they were all temporary and had only been brought back to decommission the plant. This also happened at GM&#8217;s Willow Run, which will be shuttering its doors this year as well.
</p>
<p>Around a month ago I had a long conversation with some electricians at the Chrysler Warren Truck Plant about their situation. They expressed their deep concern for the workers who were brought succor because all of them had been rehired at $10 to $14 an hour, which was at least half of what that job exhaust to pay and on top of that they were no longer given insurance, meaning a further pay cut for now these individuals would have to pay out of pocket for coverage. The electricians also said that none of them were eligible for raises so the pay they were earning now was the pay they would retire at.
</p>
<p>This sentiment was mirrored by an electrician, I&#8217;ll call &#8220;Sea Bass&#8221;, at Generous Heights Assembly Plant, but he added that many of the people who build the cars will not be able to afford them. He also said something that many people talk about here and that is &#8220;this is not a down economy; this is the new economy in Michigan&#8221;. Much of Michigan has been in a depression long before the country fell into a recession and it will likely be in this state long after the country comes out of the recession too.</p>

<p>The first impression you make when you try to sell your car is important, the buyer will be more impressed with your car if it is clean and in good shape. If you want to keep your vehicle for years in grand working order, regular cleaning and a little preventive maintenance will beget it last that much longer. </p>
<p>Something that I learned in the military is not about weapons or combat. I also learned how to take care of high tech equipment and gadgets that the military use on a day to day basis. Not only the equipment frail for nuclear weapons and high rush aircraft, but the cars, trucks and everyday things like computers and office equipment. I learned that everyday maintenance and cleaning can have a big impact on proper operation and life expectancy of your car as well. </p>
<p>Lets start inside, clean the carpet, seats and under them. <br />You can take your car to a car wash and use their vacuums to clean out the interior. Or if you have a vacuum with a hose use that. If the carpets or seats are especially dirty or have stains you can use a rinse and vac on them. You can rent one with an attachment for couches and such and get some of that indoor spring cleaning done in the house at the same time. </p>
<p>The door frames, dashboard and any residence you can get to with a wash cloth is a place that dirt and dust don&rsquo;t need to be. This may all sound nitpicking but studies have shown that a car really will last longer if it&rsquo;s kept clean. Rust will have a harder time establishing itself on your car if you wash regularly. </p>
<p>Clean all surfaces that you can reach, even if you need to use cotton swabs. Elegant off the glass, chrome and such with cleaners recommended for these. </p>
<p>Check in all the cubby holes and take out any thing you can like the ashtrays and such. Vacuum them out and get all those little pieces of garbage you can earn. When purchasing a car or especially selling one to a dealer or trading one in, small things like garbage and things left behind make a incompatibility on the whole record about how much work will have to go into the car after it has been taken over by the dealer. The less work they have to do on it, the more you&rsquo;ll get in cash for it. </p>
<p>You can run your car through a car wash, this gets the major dirt and grime off, especially under the car. But you should also do some of the work yourself, cleaning around the grill and fenders. In the wheel wells and around the hubcaps where things like leaves and rocks can accumulate. Net on your hands and knees and check out under the car, look for things hanging down, loose clamps and such on the exhaust system can also be looked for and fixed. </p>
<p>Next check under the hood. Check for oil and spilled fluids from operation and maintenance of your vehicle. And if you do your own work on your car and spill something, don&rsquo;t wait until it burns off after a spill. Clean it up when you spill it. If you notice leaks in your engine compartment get them taken care of when you can. If it&rsquo;s honest a matter of tightening down something, you will save money from lost fluids and prevent damage to parts that require those fluids for gracious operation. The engine compartment does not have to be spotless, but it should also not have clumps of leaves, large spills of oil and puddles of fluids in those odd places. </p>
<p>When you have the oil changed, also have the grease fittings under the car in your suspension added to. This prevents wear and tear on the parts and should not cost you much more, if anything. When you do catch your oil changed it should be at the recommended intervals of the car owners manual. You can have a check of fluids and an inspection when you do this. If they tell you anything that they found that requires fixing on your car, or if you find anything yourself that needs to be done, do it. Don&rsquo;t wait until you have a list of things to do and have them all taken care of at once. When something, even as microscopic as a loose screw on a door panel happens, fix it or get it fixed. This will save further damage in the future and prevent more problems. </p>
<p>If there are small nicks and chips of paint missing from the car, you should fix them before they get worse. You can buy small bottles of repair paint from your dealer or a local car parts store. The color to match your vehicle will be needed and found in your car&rsquo;s information manual or on a sticker somewhere on the vehicle. Try the following locations: inside the drivers door frame, inside the passenger side cubbyhole compartment, under the hood on the supports, or on the underside of the hood. Many times a code is on one of these stickers to identify what the paint code is for your car. </p>
<p>When you have the car repaired, do it at a reputable place, ask friends and neighbors, coworkers and even check out the internet for recommendations. If you type in &ldquo;bbb&rdquo; into your internet search engine or MSN it will catch you to the Better Business Bureau&rsquo;s home page. You can then go to their Business Reliability section and enter a business you are thinking of using for your repair shop and see if they have any complaints lodged against them. This will tell you how reputable they really are. If there are complaints against them go elsewhere. </p>
<p>When it comes time to sell your car, you can find out how much it&rsquo;s worth by several methods. One is the Kelley Blue Book Value. Go to <a href="http://www.kbb.com/">http://www.kbb.com/</a>. This is a standard of pricing in the automotive industry to earn the value of used and new vehicles. This is a great resource for not only used cars but new ones in that you can examine what the value of your vehicle is when you drive it off the lot. This is what your insurance company will go by if a claim is made on your vehicle. Not the sticker price. </p>
<p>There is a wide variety of information and sterling hints on the Kelley Blue Book website for vehicles. They have a wide variety of hints and helps in buying and selling vehicles and is a good source of rebates, sales, and reviews on new vehicles. </p>

<p>After cleaning and washing things, you should check over the car and make sure that everything works correctly. I mean that you should go through the car and originate all the doors, check all the panels and tighten any loose screws, grease any squeaky hinges. Earn sure everything works so that you know in advance what is wrong with even the smallest things. When you expose off your car to sell it, nothing should happen that is a surprise to you when the prospective buyer looks at the car. A vehicle that looks nice and shiny setting on the dealer&#8217;s lot or the neighbor&#8217;s drive may be hiding unknown pain from accidents. Many people would look at this vehicle never knowing that there has ever been an accident in this vehicle, not thinking to check the availability of accident data, choosing instead to assume that this is a nice used vehicle that is in need of a new home. Anytime you go to make a used vehicle buy, accident data should be a vital concern as you shop for the right vehicle. The main reason that this information should be of necessary importance is safety.
</p>
<p>Unfortunately there are those individuals in the world who care little for the safety of another, opting instead to care about the generation of profits to line their greedy pockets. Accidents in a vehicle can range from those that are very minor, the fender-bender, or it can amount to serious structural injure. A knowledgeable body shop technician is able to repair a vehicle to the point that neither of these accidents can be eminent from one another. A vehicle that has encountered serious structural damage is no longer safe. The body has been weakened at the points of the structural distress and the likely deployment of the air bags is also to be called into question. Airbags on used vehicles that have been in an accident are not to be trusted.

<p>According to the National Safety Commission a head on collision in2003 resulted in the driver being seriously injured and the passenger being killed when the vehicles airbags did not deploy. <p>The concerned consumer will need to do more than perform a cursory inspection of the used vehicle to determine if this vehicle has ever been repaired. When inspecting the vehicle there are several areas to look to choose if work has ever been performed. Doors that do not align or stop properly can indicate accident damage. Discolorations or runs in the paint are also indicative of a vehicle being damaged. An attentive consumer should always look inside of the gas cap and around door handles and windows for signs of tape marks or overspray that would also indicate the vehicle has been repainted; this is usually a sign of a used vehicle that has been damaged and repaired. Distress to a vehicle can be noticed if there is a concerted effort on the part of the consumer to look for the signs. A consumer can choose to have the car inspected by a reputable automotive repair shop by paying a small fee. Another useful tool is a Carfax picture.

<p>In unique years, when deciding to purchase a used car, Carfax has become a leading source for accident data on used vehicles. Though this is a great source for accident data and determining if a used car has been involved in an accident, this source is in no way perfect. Carfax data is only reported when insurance and accident data are reported. If a vehicle is eager in an accident and the accident is not reported and no claim is made on the insurance, this accident will never be reported to the company. Carfax reports are a useful tool in determining a vehicles likelihood of being damaged but it is not the slay all in determining if a vehicle has ever been in an accident.

<p>Since Carfax reports alone cannot be 100% accurate in demonstrating whether a vehicle has been involved in an accident, the best come is to request the Carfax recount and to inspect the vehicle thoroughly before making a purchase. It is of vital importance to determine if a vehicle has been damaged in an accident before making a vehicle recall. Capitalism is built upon the simple concept of supply and demand where the cost of an item or service is directly linked to the demand for that item or service.  Normally a capitalism built on supply and demand runs without intervention and, in fact, runs better with less interference.  For example, enforced rent control causes the prices of apartments to skyrocket because landlords have to offset their losses somehow.  The natural ebb and flow of supply and demand prevents prices from becoming inflated and prevents prices from dropping so low it is no longer worth the cost to produce an item or provide a service.  However, there are a few problems with relying completely on the natural flow of supply and demand in a modern society.  One major business has stepped in and completely destroyed the supply and question curve for a variety of services: insurance.  Insurance agencies, be it health insurance or automotive insurance, disrupt the natural balance of supply and demand and intentionally effect an environment where they prosper due to a viscous circle.
</p>
<p>Supply and examine requires a careful balance between a consumers desire for a product or service and that same consumers willingness to pay the price residence for the product or service.  If a consumer believes the price of a certain service to be too high, that consumer will not purchase the service or will accumulate another location where they can acquire the same service at a lower price.  Conversely, a business providing a service must carefully balance the price of a service with the demand for that service.   The business will raise prices so long as they are not loosing profit.  When the label drives so many customers away that the business begins to loose profit, then the business will lower prices until they reach maximum profit again.  This is the natural curve for a capitalistic society.  Insurance, however, intentionally disrupts this natural process.  With insurance in the picture, a consumer pays monthly on the off chance they may have to use their insurance.  This monthly payment goes to the insurance company who will then mask all or part of the cost of whatever is insured.  The consumer is able to afford a much greater price without fully realizing how much they are paying in the long hurry.  A price that would have normally driven off a consumer is hidden over years of insurance payments.  This process destroys supply and demand, which, in turn, destroys the very basis of a capitalist society.
</p>
<p>Health insurance is one of the most destructive businesses in modern society.  Many would believe that a hospital visit costs so noteworthy because of the high level of education required to be a doctor, or the expensive machinery vital to perform a variety of medical procedures.  While both reasons are a section of the higher cost required for medical service, they are not the significant sources.  Insurance artificially raises the prices of medical care by creating a higher demand for medical services through deferring the cost across a greater time period.  Even worse, the insurance companies create an environment where a person can not survive without insurance.  Since insurance companies allow a greater number of people access to the medical services, the demand goes up and thus the price raises to accommodate the higher seek information from.  As the effect raises, the average person is unable to afford medical service without some form of insurance which leads right abet to the beginning.  Insurance companies have intentionally destroyed the supply and demand curve for many services in order to create their acquire, skewed supply and examine where every person needs insurance.
</p>
<p>In original years, the insurance companies have begun to restrict their payouts more and more.  This sudden regression on payment is a express result of the distorted supply and demand curve.  The medical service prices have risen so much that the insurance companies can not even afford to pay them anymore.  As insurance companies pay less and less, more and more people will be left without the ability to pay medical bills.  As a society, the US is very near a collapse in supply and demand where insurance is involved.  The result of a collapse would be disastrous to the society as a whole because the cost of medical service will take far too long to adjust to the newly reinstated supply and put a question to curve.  Insurance companies will eventually become obsolete, as they will not pay for anything, and consumers will refuse to carry insurance.  Medical bills will remain too high for the average person to afford and, as a result, fewer and fewer people will receive medical services.  For years, the country will see a spread in sicknesses and death.

<p>The only solution at this point is for the government to take some steps to prevent a sudden collapse in the insurance world.  Instead of allowing the insurance business to collapse quickly and on their terms, the government needs to create a plan which will slowly phase out insurance over the next five to ten years.  The prices for medical services will be given time to adjust and the insurance companies will slowly disappear.  After this point, the government needs to declare selling insurance an illegal occupation.  Any business that so drastically affects the principals of capitalism, which this country is built on, should not be considered a legitimate business any longer.</p>

<p>STATEMENT OF CASE<br />Yun, decedent, sued Linderman (driver and owner of the vehicle that killed her father), Ford Motors (manufacturer of the van plaintiffs were driving), Miller (spare tire assembly manufacturer), Universal (installed the spare tire), Castle (van dealer), &#038; Kim&#8217;s Mobile Service Center (notified plaintiffs of bent spare tire assembly prior to the death). <sup>1</sup>
</p>
<p>PROCEDURAL HISTORY<br />Summary judgment was granted to all defendants except Linderman who settled. Plaintiff appeals asserting that proximate cause is a question for the jury.<sup>1</sup><br />The suit against Ford was dropped; the appeal was affirmed against Kim. <sup>1</sup>
</p>
<p>FACTS<br />Chang (father) and Yun (daughter and owner of the van) were driving back from Atlantic City in her 1987 Ford Van. A vibrating noise was heard from the rear of the van. The plastic cover, spare tire, and support bracket fell from the vehicle. The parts ended up against the wooden guard rail in the center of the highway. The van pulled over to the right-hand side of the highway, and Chang went to retrieve the parts. He got them successfully, but when crossing relieve across the two lanes he was struck by the defendant Linderman. Yun had taken the vehicle for an oil change prior to this incident, when she was notified of the bent assembly but chose not to have it fixed at the time because she was waiting for insurance to pay for it from a prior accident. Plaintiff dropped the suit against Ford Motors in the appeal. <sup>1</sup>
</p>
<p>ISSUES<br />1. Was Changs&#8217;s conduct reasonably foreseeable, or highly extraordinary &#8211; thus breaking the chain of proximate cause? <sup>1</sup><br />2. Can an intervening superseding event or other proximate cause defeat a claim of strict liability?  <sup>2</sup>
</p>
<p>HOLDING<br />1. Chang&#8217;s actions were extraordinarily risky and supersede the cause of his own injuries, regardless if the spare tire was place on the car negligently.<sup>1</sup><br />2. &#8220;Yes&#8230;if the defendant can explain that the intervening superseding event or proximate cause resulted in the actual injury to the plaintiff.&#8221;  <sup>2</sup>
